The Holistic Women's Clinic
1. Definitions and interpretation
“Agreement”: these terms and conditions of business (“T&Cs”) pertaining to the Services provided.
“Client”: person to whom the Services are provided.
“Company”: Dr Ella Husain Limited, trading as The Holistic Women’s Clinic (Company number 08243649), registered office unit F, Whetstone, Leicester, England, LE8 6ZG
The term Company will be used interchangeably with the Term “Clinic” to mean one and the same entity.
“Practitioners”: the professionals who deliver the Services at the Clinic’s premises.
“Services”: the services to be provided under the Agreement which include Menopause consultations, Holistic Gynaecology consultations, Bone scans and Ultrasound scans of the Pelvis. We provide natural hormone treatment options for women only.
“Working Day”: the day on which Services are normally provided at that location, not inclusive of public or company holidays.
2. Fees and costs
2.1 Fees payable by the Client for the Services shall be the fees chargeable by the Practitioners for such Services current at the date of provision. The Company is entitled to collect and receive fees on behalf of the Practitioners.
2.2 Fees are clearly outlined in the Clinic’s patient booking portal and will differ based on the location of booked services
3. Terms of payment
3.1 Except where otherwise agreed in writing, fees for the Services shall be due and payable by the Client on a pre-paid basis and pre-payment is mandatory to the provision of appointments and Services.
3.2 Except where otherwise agreed in writing, fees for an appointment shall be due and payable by the Client in advance of receiving the Services. The total amount must be paid in full and is non-refundable if not cancelled within 72 hours of the appointment date and time.
4.1 If a Client fails to attend or cancels an appointment with less than 72 hours’ notice, the fee is non-refundable. We commit to accommodating patients who are late to appointments as much as possible, but due to the nature of the time involved, consultations may be shortert than originally planned.
4.2 No refunds will be given after a consultation/service time and date has passed, whether the service has been received in full or in part.
4.3 Re-scheduled appointments cannot be cancelled under any circumstances. If a Client cancels or fails to attend a re-scheduled appointment they will be charged the full fee.
5. Provision of Services
The Clinic’s catalogues, brochures, leaflets or other correspondence including information published on the Company’s website are not binding and reasonable variations may be made to the Services without notice, and the Services so varied shall be accepted as complying with the Agreement.
6. Warranties and representations
Each party warrants and represents that, as at the date of this Agreement, it has full capacity and authority to enter into this Agreement. No statement, description, information, condition or recommendation contained in any Company catalogue, price list, website, advertisement or communication or made verbally by representatives of the Company shall be construed to vary in any way any of the terms of this Agreement. All other warranties (express or implied) are hereby excluded to maximum extent permitted by applicable law.
7. Modifications and additional terms
The Company reserves the right to modify these T&Cs without prior notice. When changes are made the Company will post them on this page of the Company’s website (www.thehwc.co.uk/contact)
8. Governing law and dispute resolution
The Agreement shall be governed by English Law. Any dispute under this Agreement shall be submitted to the exclusive jurisdiction of English courts.
By registering with The Holistic Women’s Clinic and accepting the terms and conditions, you are agreeing to receive general contact from the Clinic. This includes information such as your booking confirmations, appointment reminders and contact relating to your treatment support, including but not limited to, clinic consent policies for electronic signing.
10. Other terms
10.1 Force majeure: The Company shall be entitled to delay or cancel the delivery of Services or to reduce the amount of Services delivered if it is prevented from or hindered in or delayed in the provision of Services through any circumstances beyond its reasonable control including strike, lock-out, accident, war, government action, national emergency, act of terrorism, protest, riot, civil commotion, explosion, flood, epidemic, fire.
10.2 The Clinic’s Privacy and Data policy, in addition to the Clinic’s Treatment and Consent policy shall apply. These will be sent out by email for electronic signatures at the time of, or shortly after initial consultation.
10.3 The Company may assign or sub-contract its obligations or rights under this Agreement to a competent third party in whole or in part.
